US announces new tariffs over forced labour concerns

The US has announced new tariffs of 10-12.5% on dozens of countries accounting for almost all its imports over concerns they are not doing enough to tackle forced labour.
It is the second time President Donald Trump's administration has announced new import taxes since the US Supreme Court struck down many of his previous duties in February.
The US Trade Department said these countries will face the tariffs because of their failure to address the importing of goods made with forced labour.
The UK said it is tackling forced labour, China denied goods are made with forced labour, and the EU said the tariffs were unjustified.
Meanwhile, an India analyst said the move was a pressure tactic as trade negotiations between the countries continue.
Human rights groups say forced labour does exist in China and that the UK and other countries need to do more on making sure firms do not have forced labour in their supply chains.
However, they questioned the effectiveness of US tariffs as a way of dealing with the problem.

Things have got worse since 2008. African-Americans and Latinos are routinely the victims of arbitrary arrest, incarceration and inhumane exploitation in America’s profit driven private prisons.
California has adopted legislation which bans the private prison industry from operating in the state.
“The move will probably also close down four large immigration detention facilities that can hold up to 4,500 people at a time.
The legislation is being hailed as a major victory for criminal justice reform because it removes the profit motive from incarceration. 
It also marks a dramatic departure from California’s past, when private prisons were relied on to reduce crowding in state-run facilities.

Human rights organizations, as well as political and social ones, are condemning what they are calling a new form of inhumane exploitation in the United States, where they say a prison population of up to 2 million – mostly Black and Hispanic – are working for various industries for a pittance. 
For the tycoons who have invested in the prison industry, it has been like finding a pot of gold. 
They don’t have to worry about strikes or paying unemployment insurance, vacations or comp time. 
All of their workers are full-time, and never arrive late or are absent because of family problems; moreover, if they don’t like the pay of 25 cents an hour and refuse to work, they are locked up in isolation cells.
There are approximately 2 million inmates in state, federal and private prisons throughout the country. 
According to California Prison Focus, “no other society in human history has imprisoned so many of its own citizens.”
The figures show that the United States has locked up more people than any other country: a half million more than China, which has a population five times greater than the U.S. 
Statistics reveal that the United States holds 25% of the world’s prison population, but only 5% of the world’s people. 
From less than 300,000 inmates in 1972, the jail population grew to 2 million by the year 2000. 
In 1990 it was one million. 
Ten years ago there were only five private prisons in the country, with a population of 2,000 inmates; now, there are 100, with 62,000 inmates. 
It is expected that by the coming decade, the number will hit 360,000, according to reports.

What has happened over the last 10 years? Why are there so many prisoners?
“The private contracting of prisoners for work fosters incentives to lock people up. Prisons depend on this income. Corporate stockholders who make money off prisoners’ work lobby for longer sentences, in order to expand their workforce. 
The system feeds itself,” says a study by the Progressive Labor Party, which accuses the prison industry of being “an imitation of **** Germany with respect to forced slave labor and concentration camps.”
The prison industry complex is one of the fastest-growing industries in the United States and its investors are on Wall Street. 
“This multimillion-dollar industry has its own trade exhibitions, conventions, websites, and mail-order/Internet catalogs. 
It also has direct advertising campaigns, architecture companies, construction companies, investment houses on Wall Street, plumbing supply companies, food supply companies, armed security, and padded cells in a large variety of colors.”

HISTORY OF PRISON LABOR IN THE UNITED STATES
Prison labor has its roots in slavery. 
After the 1861-1865 Civil War, a system of “hiring out prisoners” was introduced in order to continue the slavery tradition. 
Freed slaves were charged with not carrying out their sharecropping commitments (cultivating someone else’s land in exchange for part of the harvest) or petty thievery – which were almost never proven – and were then “hired out” for cotton picking, working in mines and building railroads. 
From 1870 until 1910 in the state of Georgia, 88% of hired-out convicts were Black. 
In Alabama, 93% of “hired-out” miners were Black. 
In Mississippi, a huge prison farm similar to the old slave plantations replaced the system of hiring out convicts. 
The notorious Parchman plantation existed until 1972.
During the post-Civil War period, Jim Crow racial segregation laws were imposed on every state, with legal segregation in schools, housing, marriages and many other aspects of daily life. 
“Today, a new set of markedly racist laws is imposing slave labor and sweatshops on the criminal justice system, now known as the prison industry complex,” comments the Left Business Observer.

 


STATISTICS
Ninety-seven percent of 125,000 federal inmates have been convicted of non-violent crimes. 
It is believed that more than half of the 623,000 inmates in municipal or county jails are innocent of the crimes they are accused of. 
Of these, the majority are awaiting trial. Two-thirds of the one million state prisoners have committed non-violent offenses. 
Sixteen percent of the country’s 2 million prisoners suffer from mental illness.

Who is investing?
At least 37 states have legalized the contracting of prison labor by private corporations that mount their operations inside state prisons. 
The list of such companies contains the cream of U.S. corporate society: IBM, Boeing, Motorola, Microsoft, AT&T, Wireless, Texas Instrument, Dell, Compaq, Honeywell, Hewlett-Packard, Nortel, Lucent Technologies, 3Com, Intel, Northern Telecom, TWA, Nordstrom’s, Revlon, Macy’s, Pierre Cardin, Target Stores, and many more. 
All of these businesses are excited about the economic boom generation by prison labor. Just between 1980 and 1994, profits went up from $392 million to $1.31 billion. 

Thanks to prison labor, the United States is once again an attractive location for investment in work that was designed for Third World labor markets. 
A company that operated a maquiladora (assembly plant in Mexico near the border) closed down its operations there and relocated to San Quentin State Prison in California. 
In Texas, a factory fired its 150 workers and contracted the services of prisoner-workers from the private Lockhart Texas prison, where circuit boards are assembled for companies like IBM and Compaq.
[Former] Oregon State Representative Kevin Mannix recently urged Nike to cut its production in Indonesia and bring it to his state, telling the shoe manufacturer that “there won’t be any transportation costs; we’re offering you competitive prison labor (here).”

 

 


PRIVATE PRISONS
The prison privatization boom began in the 1980s, under the governments of Ronald Reagan and Bush Sr., but reached its height in the 1990s under William Clinton, when Wall Street stocks were selling like hotcakes. 
Clinton’s program for cutting the federal workforce resulted in the Justice Departments contracting of private prison corporations for the incarceration of undocumented workers and high-security inmates.
Private prisons are the biggest business in the prison industry complex. 
About 18 corporations guard 10,000 prisoners in 27 states. 
The two largest are Correctional Corporation of America (CCA) and Wackenhut, which together control 75%. 
Private prisons receive a guaranteed amount of money for each prisoner, independent of what it costs to maintain each one. 
According to Russell Boraas, a private prison administrator in Virginia, “the secret to low operating costs is having a minimal number of guards for the maximum number of prisoners.” 
The CCA has an ultra-modern prison in Lawrenceville, Virginia, where five guards on dayshift and two at night watch over 750 prisoners. 
In these prisons, inmates may get their sentences reduced for “good behavior,” but for any infraction, they get 30 days added – which means more profits for CCA. 
According to a study of New Mexico prisons, it was found that CCA inmates lost “good behavior time” at a rate eight times higher than those in state prisons.


IMPORTING AND EXPORTING INMATES
Profits are so good that now there is a new business: importing inmates with long sentences, meaning the worst criminals. 
When a federal judge ruled that overcrowding in Texas prisons was cruel and unusual punishment, the CCA signed contracts with sheriffs in poor counties to build and run new jails and share the profits. 
According to a December 1998 Atlantic Monthly magazine article, this program was backed by investors from Merrill-Lynch, Shearson-Lehman, American Express and Allstate, and the operation was scattered all over rural Texas. 
That state’s governor, Ann Richards, followed the example of Mario Cuomo in New York and built so many state prisons that the market became flooded, cutting into private prison profits.

CRIME GOES DOWN, JAIL POPULATION GOES UP
According to reports by human rights organizations, these are the factors that increase the profit potential for those who invest in the prison industry complex:
Jailing persons convicted of non-violent crimes, and long prison sentences for possession of microscopic quantities of illegal drugs. Federal law stipulates five years’ imprisonment without possibility of parole for possession of 5 grams of crack or 3.5 ounces of heroin, and 10 years for possession of less than 2 ounces of rock-cocaine or crack. 
A sentence of 5 years for cocaine powder requires possession of 500 grams – 100 times more than the quantity of rock cocaine for the same sentence. 
Most of those who use cocaine powder are white, middle-class or rich people, while mostly Blacks and Latinos use rock cocaine. In Texas, a person may be sentenced for up to two years’ imprisonment for possessing 4 ounces of marijuana. 
Here in New York, the 1973 Nelson Rockefeller anti-drug law provides for a mandatory prison sentence of 15 years to life for possession of 4 ounces of any illegal drug.
The passage in 13 states of the “three strikes” laws (life in prison after being convicted of three felonies), made it necessary to build 20 new federal prisons. 
One of the most disturbing cases resulting from this measure was that of a prisoner who for stealing a car and two bicycles received three 25-year sentences.

According to a Vice News piece titled How Private Prisons Are Profiting From Locking Up US Immigrants, Hillary Clinton and Marco Rubio have taken virtually the same amount of donations from the two most influential prison lobbyists in the U.S.:
VICE reviewed federal campaign disclosures and found that lobbying firms linked to GEO and CCA have already contributed more than $288,300 to three of the leading candidates.
Clinton's Ready for Hillary PAC received $133,246 from lobbying firms linked to GEO and CCA. Rubio's PACs and campaign have taken a total of $133,450 from private prison companies or groups that lobby on their behalf. Bush's campaign and his Right to Rise Super PAC have received $21,700 from lobbying groups affiliated with GEO and CCA.
"These companies are investing their money for a reason," said Bob Libal, the executive director of Grassroots Leadership, a group that fights to end for-profit incarceration. "That reason is to maintain policies that benefit them."

Rubio's home state of Florida has recently faced a crisis with its corrections system and has the 11th highest incarceration rate in the nation.

While Hillary Clinton expects to receive the majority of the African American vote among Democrats, mass incarceration has targeted African Americans at a higher rate than any other demographic. Thus, Clinton's willingness to accept money from the prison lobby runs contrary to the interests of a core constituency. According to the NAACP, national statistics show black citizens targeted at alarming rates by the prison system:
African Americans now constitute nearly 1 million of the total 2.3 million incarcerated population
African Americans are incarcerated at nearly six times the rate of whites
Together, African American and Hispanics comprised 58% of all prisoners in 2008, even though African Americans and Hispanics make up approximately one quarter of the US population
According to Unlocking America, if African American and Hispanics were incarcerated at the same rates of whites, today's prison and jail populations would decline by approximately 50%
One in six black men had been incarcerated as of 2001. If current trends continue, one in three black males born today can expect to spend time in prison during his lifetime
1 in 100 African American women are in prison
Nationwide, African-Americans represent 26% of juvenile arrests, 44% of youth who are detained, 46% of the youth who are judicially waived to criminal court, and 58% of the youth admitted to state prisons (Center on Juvenile and Criminal Justice).

African Americans represent 12% of the total population of drug users, but 38% of those arrested for drug offenses, and 59% of those in state prison for a drug offense.


What's most startling is that African Americans on average vote around 90% Democrat in presidential elections, yet Hillary Clinton accepted money from major prison lobbyists, even as "African Americans are incarcerated at nearly six times the rate of whites."

As for the reaction from Latino and African American civil rights organizations, these groups pressured Clinton to stop taking the prison lobby's money, as illustrated in a Huffington Post article titled Hillary Clinton Says She'll End Private Prisons, Stop Accepting Their Money:
    Lobbying firms that work for two major private prison giants, GEO Group and Corrections Corporation of America, gave $133,246 to the Ready for Hillary PAC,according to Vice. Those companies operate a number of criminal and immigrant detention facilities, some of which have been plagued by allegations of abuse and poor treatment of detainees.

    Immigrant and civil rights groups have urged Clinton to stop accepting contributions from donors with ties to GEO and CCA. Earlier Thursday, in announcing its co-founder Cesar Vargas was moving to the campaign of Sen. Bernie Sanders (I-Vt.), the advocacy group Dream Action Coalition singled out Clinton for accepting those contributions.


It's unknown if Clinton would have still accepted prison lobbyist contributions had these groups not pressured the former Secretary of State. What's also surprising is that Jeb Bush actually received less money ($21,700) than Clinton, from the same interests that target a key voter base among Democrats.


In contrast to Clinton, Rubio, and Bush, Senator Bernie Sanders has been outspoken in his desire to ban private prisons, as stated in a USA Today piece titled Bernie Sanders seeks to ban private prisons:
    Sen. Bernie Sanders said he hopes to end the "private, for-profit prison racket" with the introduction Thursday of bills to ban private prisons, reinstate the federal parole system and eliminate quotas for the number of immigrants held in detention.


With the Democratic race heating up and both Bernie Sanders and Hillary Clinton close in the polls, the issue of prison lobbyist donations will factor into the Democratic primaries. Bernie Sanders has never taken money from the prison lobby, while The Intercept wrote last year that Private Prison Lobbyists Are Raising Cash for Hillary Clinton. In addition, Bill Clinton's recent apology for his role in making mass incarceration "worse" will also be a key issue in the 2016 Democratic Primary. The Los Angeles Times writes that "The federal and state prison populations rose more under former President Bill Clinton than under any other president." This year, Hillary Clinton could be linked not only to her acceptance of prison lobbyist money, but also Bill Clinton's role in mass incarceration.

悪名高いパーチマン農園は1972年まで存在していました。
南北戦争後、ジム・クロウ法による人種隔離法が全州に施行され、学校、住宅、結婚、その他日常生活の多くの側面で法的隔離が行われました。

「今日、新たな、極めて人種差別的な法律が、刑務所産業複合体として知られる刑事司法制度に、奴隷労働と劣悪な労働環境を押し付けている」と、左派ビジネス・オブザーバーは指摘しています。

統計
連邦刑務所に収容されている12万5000人のうち、97%が非暴力犯罪で有罪判決を受けています。

市町村刑務所または郡刑務所に収容されている62万3000人のうち、半数以上が起訴された罪について無実であると考えられています。

これらの受刑者の大多数は裁判を待っています。州刑務所に収容されている100万人のうち、3分の2が非暴力犯罪を犯しています。

国内の200万人の受刑者のうち、16%が精神疾患を患っている。

投資しているのは誰か?

少なくとも37の州が、州立刑務所内で事業を展開する民間企業による受刑者労働の契約を合法化している。

こうした企業には、IBM、ボーイング、モトローラ、マイクロソフト、AT&T、ワイヤレス、テキサス・インスツルメンツ、デル、コンパック、ハネウェル、ヒューレット・パッカード、ノーテル、ルーセント・テクノロジーズ、3Com、インテル、ノーザン・テレコム、TWA、ノードストローム、レブロン、メイシーズ、ピエール・カルダン、ターゲット・ストアーズなど、米国を代表する企業が名を連ねている。

これらの企業はすべて、受刑者労働による経済成長に大きな期待を寄せている。 1980年から1994年までのわずか1年間で、利益は3億9200万ドルから13億1000万ドルへと急増しました。

刑務所労働のおかげで、米国は再び、第三世界の労働市場向けに設計された仕事への投資先として魅力的な場所となっています。

メキシコ国境付近でマキラドーラ(保税加工工場)を運営していた企業は、現地での操業を中止し、カリフォルニア州のサン・クエンティン州立刑務所に移転しました。

テキサス州では、ある工場が150人の従業員を解雇し、IBMやコンパックなどの企業向けに回路基板を組み立てているテキサス州ロックハートの民間刑務所から受刑者労働者を雇用しました。

オレゴン州議会議員だったケビン・マニックス氏は最近、ナイキに対し、インドネシアでの生産を削減し、オレゴン州に移転するよう促し、「輸送コストはかかりません。競争力のある刑務所労働力を提供します」とナイキに伝えました。

民間刑務所
刑務所の民営化ブームは、ロナルド・レーガン政権とブッシュ(父)政権下の1980年代に始まりましたが、ウォール街の株価が飛ぶように売れていた1990年代、ウィリアム・クリントン政権下でピークを迎えました。

クリントン政権による連邦職員削減政策の結果、司法省は不法滞在者や重警備受刑者の収容を民間刑務所企業に委託するようになりました。

民間刑​​務所は、刑務所産業複合体の中で最大の事業です。

約18の企業が27州で1万人の受刑者を収容しています。

最大手2社は、コレクショナル・コーポレーション・オブ・アメリカ(CCA)とワッケンハットで、両社合わせて75%のシェアを占めています。

民間刑​​務所は、受刑者一人当たりの維持費とは関係なく、一定額の保証金を受け取ります。

バージニア州の民間刑務所管理者、ラッセル・ボラース氏によると、「運営コストを低く抑える秘訣は、収容囚数を最大限に増やすために、警備員の数を最小限に抑えることだ」とのことです。

CCAはバージニア州ローレンスビルに最新鋭の刑務所を所有しており、日勤は5名、夜勤は2名の警備員が750名の囚人を監視しています。

これらの刑務所では、囚人は「模範囚」として刑期が短縮される可能性がありますが、何らかの違反行為があれば30日間の刑期が加算されます。これはCCAにとって利益の増加につながります。

ニューメキシコ州の刑務所に関する調査によると、CCAの囚人は州立刑務所の囚人に比べて、「模範囚としての刑期」を失う割合が8倍も高いことが判明しました。

囚人の輸入と輸出
利益があまりにも大きいため、新たなビジネスが生まれています。それは、長期刑の囚人、つまり最悪の犯罪者を輸入することです。

連邦判事がテキサス州刑務所の過密状態を残酷かつ異常な刑罰と認定すると、CCA(刑務所管理会社)は貧困地域の保安官と契約を結び、新たな刑務所の建設・運営と利益分配を委託した。

1998年12月のアトランティック・マンスリー誌の記事によると、この事業はメリルリンチ、シアソン・リーマン、アメリカン・エキスプレス、オールステートなどの投資家によって支援され、テキサス州の農村部全域に事業が展開されていた。

テキサス州知事のアン・リチャーズは、ニューヨーク州のマリオ・クオモの例に倣い、州立刑務所を大量に建設したため、市場は供給過剰となり、民間刑務所の利益は減少した。

犯罪減少、刑務所収容者増加
人権団体の報告によると、刑務所産業複合体への投資家の利益を高める要因は以下の通りである。
非暴力犯罪で有罪判決を受けた者を投獄すること、そして微量の違法薬物所持で長期刑を科すこと。連邦法では、クラック5グラムまたはヘロイン3.5オンスの所持に対して仮釈放なしの懲役5年、クラックまたはロックコカイン2オンス未満の所持に対して懲役10年が規定されている。

コカイン粉末で懲役5年の刑を受けるには500グラムの所持が必要であり、これは同じ刑を受けるクラックコカインの量の100倍に相当する。

コカイン粉末の使用者のほとんどは白人の中流階級または富裕層であり、一方、クラックコカインの使用者は主に黒人とラテン系の人々である。テキサス州では、マリファナ4オンスの所持に対して最長2年の懲役刑が科される可能性がある。

ここニューヨーク州では、1973年のネルソン・ロックフェラー麻薬取締法により、あらゆる違法薬物4オンスの所持に対して15年から終身刑の懲役刑が義務付けられている。

13州で「三振法」(3回の重罪で有罪判決を受けた場合、終身刑となる法律)が可決されたことにより、新たに20の連邦刑務所を建設する必要が生じた。

この法律によって生じた最も衝撃的な事例の一つは、自動車1台と自転車2台を盗んだ罪で、それぞれ25年の刑を3回言い渡された囚人のケースである。

薬物使用者数は白人がアフリカ系アメリカ人の5倍であるにもかかわらず、薬物犯罪で刑務所に送られる割合はアフリカ系アメリカ人が白人の10倍にも達します。
薬物使用者全体の12%がアフリカ系アメリカ人ですが、薬物犯罪で逮捕された人の38%、薬物犯罪で州立刑務所に収容された人の59%がアフリカ系アメリカ人です。


最も衝撃的なのは、アフリカ系アメリカ人は大統領選挙で平均して約90%が民主党に投票しているにもかかわらず、ヒラリー・クリントンは主要な刑務所ロビイストから献金を受け取っていたことです。しかも、「アフリカ系アメリカ人の投獄率は白人の約6倍」という状況下でです。

サンダース上院議員は、木曜日に提出した、民間刑務所の禁止、連邦仮釈放制度の復活、そして収容される移民の人数制限の撤廃を盛り込んだ法案によって、「営利目的の民間刑務所ビジネス」を終わらせたいと述べた。


民主党の予備選が白熱し、バーニー・サンダース氏とヒラリー・クリントン氏の支持率が拮抗する中、刑務所ロビイストからの献金問題は、民主党予備選の重要な争点となるだろう。バーニー・サンダースは刑務所ロビーから資金を受け取ったことは一度もないが、The Interceptは昨年、民間刑務所ロビイストがヒラリー・クリントンのために資金を集めていると報じた。さらに、ビル・クリントンが大量投獄を「悪化させた」ことについて最近謝罪したことも、2016年の民主党予備選の重要な争点となるだろう。ロサンゼルス・タイムズは、「連邦刑務所と州刑務所の収容者数は、ビル・クリントン元大統領の下で、他のどの歴代大統領よりも増加した」と報じている。今年は、ヒラリー・クリントンは刑務所ロビイストからの資金受領だけでなく、ビル・クリントンの大量投獄における役割とも結びつけられる可能性がある。
