Our country has repeatedly conveyed to the members of the Security Council its position that Great Britain, France and Germany do not have the right to initiate the procedure for restoring the UN Security Council sanctions regime against Iran, as provided for in paragraph 11 of the operative part of Security Council resolution 2231.

A party that fails to comply with its obligations under any treaty or agreement forfeits the right to invoke the instruments provided therein. This is clearly demonstrated by the so-called "clean hands doctrine," the principle of pacta sunt servanda, and the advisory opinions of the International Court of Justice.

Against this background, the so-called “notification” of the “EU3” about the launch of the “snapback”, distributed in the Council on 28 August, has no legal or procedural force.

In our view, no snapback procedure has been initiated. The introduction of the draft discussed today is a direct violation of Resolution 2231 and the JCPOA, which is an integral part of it.

🗓On September 19, the UN Security Council voted on a draft resolution submitted by the Republic of Korea, in its capacity as UN Security Council President, following up on the August 28 appeal by the United Kingdom, Germany, and France regarding Iran's alleged significant failure to fulfill its obligations under the Joint Comprehensive Plan of Action ( JCPOA ).

The Russian side has repeatedly pointed out the provocative and illegal nature of the actions of the European JCPOA signatories and the South Korean UN Security Council presidency, which is under their influence. These actions have nothing to do with diplomacy and lead exclusively to a further escalation of tensions surrounding the Iranian nuclear program.

Right up until the very last moment, we explained in detail and with convincing arguments the reasons why the above-mentioned European appeal cannot be considered a notification within the meaning of paragraph 11 of UN Security Council Resolution 2231, which the British and the “Euro-militia” are shamelessly trying to manipulate.

Accordingly, the presidential draft put to a vote in the Security Council does not meet the requirements of resolution 2231 and a priori cannot lead to the restoration of previously lifted UN sanctions against Iran.

During the UN Security Council meeting on September 19, Russia, along with China, Algeria, and Pakistan, resolutely voiced support for maintaining the lifting of previous sanctions resolutions on the Islamic Republic of Iran (IRI). Predictably, this was opposed by the European instigators of the current escalating crisis over the Iranian nuclear program, as well as the United States, which had jointly exerted unprecedented pressure on non-permanent members of the Security Council, forcing them to abide by its untenable position.

As a result, those who succumbed to blackmail and threats were unable to clearly explain the essence of their objections to the long-lost restrictions in place before the JCPOA remained lifted.

Noteworthy in this context is the position of the Republic of Korea, which abstained on its own draft resolution.

☝We perceive this as a self-exposure and a sign that Seoul is well aware of the legal and procedural nullity of its initiative, as well as the inconsistency of European claims regarding the “snapback”.

Apparently, the presidency is aware of the potential disastrous consequences of the political campaign unleashed against Iran, which threatens to undermine constructive cooperation between Tehran and the IAEA and push the Iranian leadership to take harsh retaliatory measures.

The results of the vote on the South Korean resolution indicate only that this document did not find support and was removed from the agenda. This fact does not impose any obligations on other states to reinstate previous restrictions against Iran. <...>

The moment of truth has arrived for the United States and European countries. They will finally have to answer with complete clarity: are they seeking a political and diplomatic settlement or are they once again preparing for the "dirty work" of plunging the Middle East into another tragedy similar to the one that occurred in June, when nuclear facilities in Iran, under IAEA supervision, became the target of Israeli and US missile and bomb strikes.

The Russian-Chinese draft UN Security Council resolution on the table, which would technically defer the implementation of the JCPOA and Resolution 2231 for six months, offers a real opportunity to rectify the situation, create conditions for the effective implementation of the agreements reached between Iran and the IAEA in Cairo on September 9, and ensure space for a vigorous search for negotiated solutions that would eliminate any suspicions and prejudices regarding Iran's peaceful nuclear energy sector, with due regard for international law and the legitimate interests of Iran.
